Free Exercise Clause Definition The Free Exercise Clause is the part of the First Amendment that reads: Congress shall make no law ... prohibiting the free exercise (of religion) ... The Supreme Court has, of course, never interpreted this clause  in a completely literal way. Murder is illegal, for example, regardless of whether it is committed for religious reasons. Interpretations of the Free Exercise Clause   There are two interpretations of the Free Exercise Clause: The first freedoms interpretation  holds that Congress may restrict religious activity only if it has a compelling interest in doing so. This means that Congress may not, for example, ban the hallucinatory drug peyote that is used by some Native  American traditions because it has no compelling interest in doing so.  The nondiscrimination interpretation holds that Congress may restrict religious activity as long as the intent of a law is not to restrict religious activity. Under this interpretation, Congress can ban peyote as long as the law is not specifically written to target a specific religious practice. Interpretation largely  becomes a non-issue when religious practices stay within the confines of the law. The First Amendment clearly protects an American’s right to worship as he chooses when the practices of his religion are in no way illegal. It’s typically not illegal to confine a venomous snake in a cage at a service, for example, provided all wildlife licensing requirements are met. It might be illegal to turn that venomous snake loose among a congregation, resulting in a worshiper being struck and subsequently dying. The question becomes whether the worship leader who turned the snake loose is guilty of murder or – more likely – manslaughter. An argument can be made that the leader is protected by the First Amendment because he did not set the snake free with the intent of harming the worshiper but rather as part of a religious rite.   Challenges to the Free Exercise Clause   The First Amendment has been challenged numerous times over the years when crimes are unintentionally committed in the course of practicing religious beliefs.  Employment Division v. Smith, decided by the Supreme Court in 1990, remains one of the more noteworthy examples of a bona fide legal challenge to the first freedoms interpretation of the law. The court had previously held that the burden of proof fell to the governing entity to establish that it had a compelling interest in prosecuting even if it meant infringing upon the individual’s religious practices. Smith changed that premise when the court ruled that a governing entity does not have that burden if the law that was violated applies to the general population and does not target the faith or its practitioner per se.   This decision was tested three years later in a 1993 decision in Church of the Lukumi Babalu Aye v. City of Hialeah. This time, it held that because the law in question – one that involved animal sacrifice – specifically affected the rites of a certain religion, the government did indeed have to establish a compelling interest.

I grew up in Hawaii and almost everyone in town knew me. Plus, I had friends and relatives here, and my children had become used to this place. My excitement was gradually waning, and I found myself lost in these thoughts.I knew that I couldn’t take this decision, without consulting my children, so I went to their bedroom and woke them up. S urprisingly, they did not react much to this news and took it quite calmly. I did emphasize that how important this job was to me, and that I was only doing it for them and to secure their future, but I didn’t put much pressure on them and asked them to take their time. After this, I ambled outside the room and waited. Not much time had passed by when the door creaked open and both my children walked out. This was one of the happiest moments of my life, and I was so thrilled to realize that how supportive my children were.

Chaim Potok’s My Name Is Asher Lev Novel Analysis

Chaim Potok's Asher Lev is a dual being trapped inside a little boy. On one side there is the family's beliefs, the religious traditions and his great ancestor role-model, who Asher is expected to take after, if not surpass. On the other, there is art encompassing the artist's emotions and portraying them in form more beautiful than anything else Asher has access to. These sides clash almost throughout â€Å"My Name is Asher Lev†, but even though those close to him teach, reinforce and often force religion and traditions on to him, art eventually prevails.Asher does not make the inevitable choice alone and even then there is no single choice to make. Instead, he squirms around the issue until his personality is fully formed with the help of the people around him, specifically, his mother and father, his mentor Jacob Kahn. The personality that he does form seems to be the best of both worlds in a world where dualism rules all. The first agent of change in Asher was his mother. Throughout the novel, she did her best to stay between her husband and her son, but still enforce Asher's abilities.If not for her interest and love towards Asher's drawings as well as their trips to the museum and her buying most of the art supplies, Asher would not have had the support he needed to go on instead of giving in to his heritage. Not only that, but Rivkeh was also Asher's muse. She was often the focus of most of his artwork, even being the centerpiece in his (for now) magnum opus – the two paintings of the crucifixion. In addition, she also gave Asher something to reach for: â€Å"You should make the world pretty, Asher† (Potok, 30), because at that time, Asher's drawings were the only beauty Rivkeh saw in life.Possibly the most obvious push for Asher was Jacob Kahn. Not only an art mentor, Kahn also shared his philosophy and views of religion. However, Asher took only the techniques to heart. He understood and acknowledged Kahn's viewpoint, but his silen ce during most of their discussions did not seem to be of a thoughtful nature. In the long run, Kahn did not seem to have much impact on the boy's morality and he soon started focusing more and more on producing art instead of religious meditation.Asher was not only influenced by Kahn's philosophy, but was also exposed to a world previously unknown to him: â€Å"Asher Lev, you are entering the wrong world† (Potok, 184). Asher did not take to the new world. He was a spirit, existing in the artists' world, but not being part of it. He was his own man, the same as his philosophy was his own, if a mix of the ones he's been exposed to and the ones which he acknowledged as being true. An unlikely force of change was Asher's father – Aryeh. Throughout the novel, he was nothing short of an impenetrable wall for Asher's ambition.Only a few glimmers of hope came up, when it seemed like he would be willing to accept his son's gift or, at least tolerate it, but something always ca me up between them and their relationship fell back to where it was or often even further. At the beginning of the story, it seemed like Aryeh's distaste and disapproval of Asher's drawings would be a forbidden fruit for the boy and actually make him want to evolve his gift further, but that was not the case. Every time his father scolded him, Asher compared his abilities with something that he perceived to come from the Other side, or abhorrent.However, Aryeh has a special role in the novel and that is comparison with a hint of hypocrisy. The reader first found out that Aryeh worked in an office arranging something on the telephone, often in another language. It later became apparent that Aryeh hated what he did and wished he could be out there, physically talking to people and helping them that way, instead of crammed up in an office building: â€Å"I should be there, not here. How can I spend my life talking on the telephone? Who can sit like this all day? (Potok, 29). It was al so made clear that he took the job upon request from the Rebbe. In fact, most of the family's important future decisions were made by the Rebbe. Where Aryeh's and Asher's situations start to seem familiar is that both men were doing something they loathed on the account of the Rebbe (as well as most people, in Asher's case). They both were expected to serve the Ribono Shel Olom in the way they were prescribed to and they both disliked it, wishing they could act upon their true calling.The difference lies in the fact that Aryeh was eventually allowed to act on his wish at the price of hurting his family by being so far away, while Asher hurt his family by disobeying their wishes and in most cases, being near. Asher does not make a complete transformation. Unlike what Aryeh believes, Asher does not seem like he will ever hang his kippah as he does still holds on to the traditions he has grown up with. His conflict was never with his beliefs but with what the ones closest to him percei ved a proper Jewish boy to be.Therefore, Asher does not leave his home without any regard to his faith. He accepts the Rebbe's wishes and does not hold any grudges; he simply does what the hierarchy demands, once more, not unlike when he was a child, leading to question whether Asher transformed at all. Asher Lev in Potok's novel My Name is Asher Lev does the impossible – he fused his religious beliefs and familial values with the artistic world of the Other side. He lives his life through his art by producing his deepest feelings onto canvas from the childish drawings of flowers, to his mother, to his painting of the crucifixion.The way he was taught and treated by those around him eventually shaped who he was, but instead of religion being a choice, it became an integral part and instead of art being a choice either, it turned into a goal. Asher never had a crippling choice to make, nor did he transform. He simply grew up with the values he was instill either by his family or by God and even though there were the few who pointed him in certain directions, he would never have turned out any different than he was.

“Don’t worry, it’s a 20 minute drive!” – Creative Writing

It's 8. 40 and we've just got off the plane. It was the longest flight of our lives. With a three hour delay while we were stuck on the plane and then the luggage getting lost. My suitcase managed to get on a flight to Miami and my mums' to Barcelona! Sometimes I wonder, do the suitcases just sprout legs and go someplace they've never been before? We were tired and hungry. We had been awake for almost 20 hours at a stretch and were desperate to flop on to a soft bed and sleep! As we hurriedly looked around for a taxi to get us to our hotel, a tall, tanned lady walked up to my dad and asked him if he wanted to rent a car. Typically, my dad thought it was a good idea. You may not know this, but my family and I, have all experienced my dad's driving in a foreign city, and believe me it is no where close to good. So, amidst out cries of protest, my adamant dad marched up to the rent-a-car counter and asked for a people carrier. After standing around for another half hour, the lady showed us to a lift and told us our car would be waiting downstairs. We found that we had a bright green people carrier to drive around New York for the week that we were there. After moaning and groaning we all got in the car, and my dad ad started driving to the exit of the parking lot when he suddenly braked and started reversing back to the lift where the lady was still standing and waving. He had forgotten to ask for directions. He sat back in his seat mumbling about â€Å"turn right at the light, then take a U turn and head back east on the thru way. At exit 443 take a right and follow signs to the†¦ or was it turn right then left and then take a U turn? † My mum was already furious with my dad for agreeing to the idea of the car. Tight lipped, in her â€Å"this is so annoying† voice she asked my dad if he was sure of where he was going. Obviously no man likes to dmit he's not sure so in his very false voice he assured my mum that he was positive about where we were going and that the lady had told him its only a â€Å"20 minute drive† and â€Å"not to worry†. The lady couldn't have been more wrong. She obviously misjudged my dad and may have over-estimated him when she saw his international driving license. â€Å"Wroom, Wrooom†, the vehicle, startedas though we were about to begin a race. It was warmed up and all set to embark on the race against time. Our course was unknown and we had one of the slowest drivers of all time. Taking it at 5Km an hour, we took 20 minutes alone to get ut of the three-storey parking lot. How long was it going to take us to get to the hotel? When we eventually got on the road, my younger brother said he needed the toilet. As usual my mum taking charge asked my brother to wait 20 minutes while we got to the hotel, while giving my dad a very wary look. I think, having a mothers instinct she knew that stopping anywhere would just prolong this dreaded journey and we would all end up traipsing to bathroom and making an even bigger mess of ourselves. Luckily, my dad made a good guess and we turned on to the right road. It was usually my brother managed to get s to our planned destination, because my dad's sense of direction is as good as any bird that flies into a window. Tired of directing my dad during previous escapades like this, my brother had flat out refused to do any sort of map reading. After much driving on a straight, dimly lit road there was finally a lonesome turning to the right, which my dad decided to take. Obviously, our good luck had to run out at some point, and this was the time. We were on a nameless bridge which we later found out was the Brooklyn Bridge. It was now when my mother began panicking. We had been driving for 25 minutes already and there was still no ign of getting to Manhattan Island. While my mum was muttering to herself about how we wouldn't make it to the hotel in time and that they would cancel our booking, my dad just said that being on the bridge gave us a view of the beautiful city of New York at night. All we had left now was to â€Å"follow the signs and arrows. † The average person might ask, how difficult could it be to follow signs? Obviously, this hadn't had the experience of a lifetime: A car journey with my dad. So, driving along the Brooklyn Bridge, my brothers and I were taking my dads advice and were enjoying the view, when we made a very unexpected stop. We had just come to a tollbooth. Now, having arrived a mere hour ago we hadn't had the chance to acquire any spare change, so my dad had to reach into his secret money belt which was tucked under his shirt, and he pulled out 50 dollars. The man taking our money gave my dad a very shocked look as he gave back 48 dollars and 50 cents. Luckily, my dad had thought that it was a good idea to ask the man how to get to Manhattan Island. He told us to take the second exit on the left and then follow the signs. We did just that. Or we thought we did. I think it was because we weren't accustomed to the American accent; either that or the guy was trying to lead us into Harlem on purpose. Harlem is supposedly the most dangerous neighborhood in New York. At hearing the news, my mum became really hysterical; she kept yelling useless opinions like: â€Å"I told you not to get the car! Now were all going to get shot! Why do you have to put all our lives at stake? † My dad just raised his eyebrows and carried on driving. My brother was complaining that he was really desperate for the bathroom, and that just got my mum started again with things like: â€Å"Look at what you've done! We can't even stop any where because we're in HARLEM nd his bladders going to burst, and†¦. and†¦. † At this point I just blocked my mum out. Before we knew it, thanks to the well-lit signboard pointing us out of Harlem we were back on the Brooklyn Bridge. My mum calmed down, but only very slightly. Anything was appreciated at this time, because it was nearly 11. 30 and my brothers and I were dying with tiredness. My dad just kept driving. He was wide-awake. How? I don't know, but I had a fealing it may have had something to do with the 3 cups of coffee he had on the plane. Shockingly, we ended up at another tollbooth and asked directions. Again. After about 10 minutes of nodding, ointing and looking at the map, we were finally on our way. It was like Christmas come early when we reached a turn off. We were finally getting of the bridge! Suddenly, all our sleepiness left us. We were back to a wide-awake state and were all excited to finally be going somewhere. What seemed like 10 minutes later, we were getting out of the dreaded people carrier and were walking in to the hotel. The first thing my brother did was make a beeline for the bathroom.
